A legal case involving a former ADOR employee and Min Hee Jin, the ex-CEO of ADOR, has been referred to mediation by the Seoul Western District Court. This decision suggests the possibility of resolving the matter through a settlement rather than a formal trial. The case revolves around allegations of defamation, unfair labor practices, and an alleged cover-up of a sexual harassment incident.
Mediation Ordered by Court
On December 13, the Seoul Western District Court’s 51st Civil Division referred the case for mediation. The court has urged both parties to attempt a mutual settlement to avoid a prolonged trial. This development follows the lawsuit filed in August by the former ADOR employee, referred to as A, who is seeking 100 million KRW in damages.
Background of the Case
The legal dispute began when A accused Min Hee Jin of defamation and alleged violations of the Personal Information Protection Act. The accusations included claims that the ex-CEO covered up a sexual harassment incident involving ADOR’s former Vice President, referred to as B. Below are the key allegations:
- Sexual Harassment Cover-Up: A reported that she was sexually harassed by B during her tenure at ADOR. When she informed Min Hee Jin, A claimed that no action was taken to address the issue. Instead, Min Hee Jin allegedly sided with the accused executive to suppress the matter.
- Defamation and Retaliation: A alleged that Min Hee Jin defamed her by accusing her of violating the Personal Information Protection Act when she attempted to expose the issue. This led A to file a defamation lawsuit against Min Hee Jin, accusing her of making false claims.
- Unfair Labor Practices: A also filed complaints with the Seoul Western District Office of Employment and Labor, accusing Min Hee Jin and B of unfair labor practices and workplace harassment.
Financial Implications
As part of the legal proceedings, the court issued a seizure order on Min Hee Jin’s Yeonam-dong residence for the amount claimed by A. This action ensures the payment of damages if the settlement is not reached or if the court rules in A’s favor. The seizure order could be enforced if Min Hee Jin fails to comply with any payment directives.
Next Steps
With the court’s referral to mediation, both parties now have the opportunity to negotiate and potentially resolve the case without further litigation. The outcome of the mediation process will determine whether the case proceeds to trial or concludes amicably.
