The death of Foggy Nelson in the first few minutes of Daredevil: Born Again remains one of the most discussed and emotional moments in recent Marvel television history. As the show prepares for its second season on Disney+, new details have emerged about how the creative team almost chose a very different path for the beloved character.

The Scene That Changed Everything
When Daredevil: Born Again premiered in March 2025, audiences watched Elden Henson‘s Foggy get shot by Wilson Bethel‘s Bullseye outside Josie’s Bar. The moment happened before the opening credits even rolled. Matt Murdock, played by Charlie Cox, held his best friend as he died. Karen Page, portrayed by Deborah Ann Woll, could only watch in horror.
Showrunner Dario Scardapane made a key choice about this scene. In the original plans before he joined the project, Foggy’s death was going to happen off-screen. Scardapane refused to do it that way. “It was in the material that I inherited, but unfortunately, it was off-screen. And I felt really strongly that if we were to do something that earth-shattering and something that was going to cause such a ripple effect in Matt’s life, we had to see it and we had to feel it,” he explained.

The Alternate Plan That Almost Happened
Many fans held onto a theory throughout Season 1. They believed Foggy was not actually dead but locked away in one of Wilson Fisk‘s secret cages. Vincent D’Onofrio, who plays the Kingpin, and Cox addressed this theory in a recent interview with Entertainment Weekly.
Cox revealed something surprising. The creative team actually discussed making that theory real. “So I’ll tell you what’s impressive about that. I remember there was a moment where they discussed the possibility of that being the case,” Cox said.
The alternate plan would have shown Foggy alive in a cage at the end of Season 1. This would have set up a rescue story for Season 2. The team decided against it because they felt it did not fit the realistic tone of their show. “Sadly, that was not the case because we didn’t believe that it was realistic. And the thing about our show is we try to keep it as realistic as possible,” Cox explained.

Why Marvel Decided To Kill Foggy
Brad Winderbaum, Marvel Studios’ head of streaming, television, and animation, spoke openly about how hard this decision was. “The death of Foggy was something that we really agonized over,” Winderbaum said. He compared it to the death of Gambit in X-Men ’97, noting that both characters represent something essential to their stories.
Director Aaron Moorhead explained the thinking behind the brutal nature of the death scene. “The reason that it’s so violent is that the violence is grotesque and has real consequences. If there’s going to be two acts of violence, Foggy’s death and then Matt trying to kill someone and crossing this line, the grief needs to ripple out — not through the end of the episode, but forever,” Moorhead told Variety.
Cox admitted during a convention in Monterrey that he understands why fans are upset. When asked directly if Foggy could still be alive, he gave a clear answer. “Daredevil heard his heart stop. He’s dead. I’m sorry. I’m very sad. I am. I love that theory, but it’s wrong,” Cox said at La Conve Monterrey.
Elden Henson Reacts To His Character’s Fate
For Elden Henson, who played Foggy since the original Netflix series began in 2015, the decision was not something he asked for. During a roundtable discussion with his co-stars, Henson kept his response short but honest. “Not my idea,” he said. “Pretty sad. I really liked playing Foggy.”
Despite the tragic ending for his character, Henson found value in returning one last time. The scene where the three friends reunite at the bar before the shooting was special for the cast. “There was a reunion before we destroyed it,” Henson said, referring to the brief happy moments shared between Matt, Foggy, and Karen.
How Foggy Will Appear In Season 2
Daredevil: Born Again Season 2 arrives on Disney+ on March 24, 2026. The series will be available for viewers in the USA, UK, Canada, Australia, and India (on JioHotstar). Fans already know that Elden Henson is confirmed to return. But how can a dead character come back?
The likely answer is flashback sequences. Since Matt has been dealing with the trauma of losing his best friend throughout the story, memory scenes make sense. This would allow Henson to appear without undoing the emotional weight of the death.
Some fans hoped for a witness protection storyline, which actually comes from the Daredevil comics. In the comics, Foggy once faked his death and entered witness protection after being stabbed. But Cox’s recent statements suggest the show will not go in that direction.
What Season 2 Brings For Matt Murdock
The upcoming season focuses on Mayor Wilson Fisk and his anti-vigilante task force. The war between Matt and Fisk grows even more intense. Krysten Ritter returns as Jessica Jones, adding another layer to the story.
Producer Sana Amanat described the second season as a fresh start for the creative team. After the complicated production of Season 1, which had to stitch together different versions of the show, Season 2 allowed them to build freely. “The landscape was open, and that was so liberating. We were like, ‘We can do whatever we want,’” Amanat told Empire.
For Matt Murdock, the ghost of Foggy Nelson remains a constant presence. D’Onofrio defended the character’s importance after a fan suggested the show treated Foggy as a problem to remove. “Elden means so much to all of us. Elden’s Foggy was not and never will be a hindrance,” D’Onofrio wrote on social media.

Cox himself admitted that even now, thinking about the death still hurts. “I’m gutted, man. I’m gutted about it. Truly. I often think of Foggy Nelson as the heartbeat of the MCU. He’s integral to Matt’s life, Matt’s history… and Elden has done such a beautiful job with that character for so many years,” Cox said.
The show has been renewed for a third season, set to air in 2027. But for now, fans can watch Season 1 on Disney+ and prepare for the sophomore season arriving March 24, 2026.
