Chris Brown walked out of Southwark Crown Court on Monday, October 26, 2026, without handcuffs and without a prison cell waiting for him. The 37-year-old Grammy-winning singer was sentenced to eight months in prison, suspended for 12 months, for his role in a 2023 bottle attack at a private members’ club in London’s Mayfair district. The sentence means he will not serve time behind bars unless he commits another offence during the suspension period.

The hearing closed a case that began more than three years ago and involved a violent confrontation captured on the club’s surveillance cameras. Brown’s co-defendant, Omololu Akinlolu, 40, a rapper and vocal coach also known as HoodyBaby, received a four-month sentence, also suspended for 12 months. Both men were ordered to pay £1,500 in prosecution costs.

What Charges Did Chris Brown Face?

Brown originally faced a set of serious charges: assault, attempting to cause grievous bodily harm, and having an offensive weapon, namely a bottle. He denied all of them. In July 2026, he pleaded guilty to a single count of affray at Southwark Crown Court. In exchange for that plea, prosecutors dropped the more serious charges.

Affray is a UK offence defined as using or threatening violence towards someone in a way that makes them fear for their safety. It carries a maximum sentence of three years in prison. Akinlolu also admitted affray and had his assault and grievous bodily harm charges dropped.

What Happened at the Tape Nightclub?

The incident took place in the early hours of February 19, 2023, at Tape London, a private members’ club in Mayfair. Prosecutors said Brown approached Abraham “Abe” Diaw, a music producer and former friend, on the dancefloor shortly after 3am.

CCTV footage played in court showed Brown holding what prosecutor Heidi Stonecliffe KC described as a “heavy square shaped tequila bottle”. He struck Diaw twice on the left side of his head, then hit him again on the shoulder as Diaw tried to turn away. Akinlolu grabbed Diaw in a “bear hug”, and Diaw fell to the ground, where Brown was seen throwing punches.

Diaw was taken to St Mary’s Hospital with head and knee injuries. An MRI scan later showed a high-grade ligament injury on the inner side of his left knee. The Crown Prosecution Service described the attack as “vicious and unprovoked”.

“They continued their assault whilst the victim attempted to flee through the club. The victim was kicked while he was seated defenseless on the floor.” — Claire Campbell, senior crown prosecutor, CPS London South

What Sentence Did the Judge Hand Down?

Judge Tony Baumgartner sentenced Brown to eight months’ imprisonment, suspended for 12 months. Akinlolu received four months, suspended for 12 months. Both were told to pay £1,500 toward legal costs.

A suspended sentence means Brown will not be sent to prison immediately. He will only serve the eight months if he commits another crime within the next 12 months.

What Did the Judge Say About the Attack?

Judge Baumgartner was direct about the seriousness of the violence. He told the court that Brown’s fame did not place him above the law.

“The repeated use of a glass bottle in that way, especially aimed at the head, was plainly dangerous, it carried the risk of delivering a more serious injury than was ultimately sustained.” — Judge Tony Baumgartner

“Your fame, commercial success and professional standing do not entitle you to special treatment. The law applies equally to everyone.” — Judge Tony Baumgartner

The judge also noted that the violence took place in a crowded nightclub and lasted around 20 seconds.

How Did Brown Respond in Court?

Brown’s defence lawyer, Sallie Bennett-Jenkins KC, told the court the incident was “ugly and unattractive” but “very short-lived”. She said Brown offered a “profound apology” to everyone present at the club.

Brown sat in the dock looking at the floor for much of the hearing, wearing a black leather jacket and a face mask. Outside the court, he stopped to sign autographs and blew a kiss to fans who had gathered.

Why Was Brown Arrested in 2025?

Brown left the United Kingdom shortly after the February 2023 incident. A warrant was issued for his arrest after Diaw was hospitalised. In May 2025, Brown returned to Britain for a concert in Manchester and was arrested at a hotel by London’s Metropolitan Police.

He was initially denied bail, which put his Breezy Bowl XX world tour in doubt. He was later released after agreeing to a £5 million security fee — about $6.7 million — and surrendering his passport when entering each country on tour.

Brown’s Legal History Stretches Back to 2009

The London case is not Brown’s first brush with the law. In 2009, he pleaded guilty to assaulting his then-girlfriend Rihanna hours before the Grammy Awards. He received five years of probation. In 2013, he admitted to an assault on a fan outside a hotel in Washington, D.C.. In 2019, he was arrested in Paris and questioned on suspicion of r*pe but was released without charge.

Brown won his first Grammy in 2011 for Best R&B Album for “F.A.M.E.” and his second in the same category in 2025 for “11:11 (Deluxe)”.

What Happens With a Suspended Sentence?

Brown is free to continue his career and travel, provided he does not commit another offence in the UK during the 12-month suspension. The £1,500 costs payment is separate from the suspended prison term. Akinlolu faces the same conditions under his four-month suspended sentence.

Online reaction to the sentencing has been sharply divided. Under a news report about his earlier guilty plea, one commenter wrote that Brown’s “rap sheet of assaults is too long”, while another said, “People will put up with anything if you’re insanely talented.” A different commenter criticised his supporters directly: “Enabled by his dumbass fans”.
