Sean ‘Diddy’ Combs has proposed a temporary residence in Manhattan’s Upper East Side if granted bail ahead of his May 2025 trial. The decision regarding his bail request is expected next week.

Bail Hearing and Proposal Details

On Friday, November 21, 2024, during a hearing at a Manhattan courtroom, Combs, 55, put forth the Upper East Side as his proposed residence until his trial. He has been facing charges of sex trafficking, racketeering, and transportation, stemming from his September 16 arrest at a New York City hotel. Combs has pleaded not guilty to all charges.

The hearing, which lasted two hours, concluded without a decision, marking Combs’ third attempt at securing bail since his arrest. As he entered the courtroom, Combs was seen wearing khaki jail attire. He greeted his family, including his 17-year-old twin daughters, who were seated in the audience.

Legal Arguments and Conditions for Home Confinement

During the hearing, both parties presented intense arguments. The prosecution argued that Combs “cannot be trusted” to comply with any conditions of bail, particularly citing past allegations of witness tampering. The defense, on the other hand, outlined strict conditions for home confinement that they argued were more restrictive than jail, including limited phone access to lawyers, a visitor’s log, and avoiding contact with potential witnesses.

Judge Arun Subramanian directed both the prosecution and defense to submit written proposals by Monday, November 25, at noon, detailing the types of communication Combs would be allowed if granted bail and home confinement.

Previous Bail Rejections and Witness Tampering Allegations

This marks the third time that Combs has attempted to secure bail. Two previous judges denied his requests, citing concerns that Combs might attempt to tamper with witnesses. Prosecutors recently claimed that Combs, even while in custody, had made continuous efforts to contact potential witnesses, including victims who could testify against him.

Combs’ Legal Battle and Potential Sentence

In addition to the bail hearing, Combs had another court appearance earlier in the week on November 19. During that hearing, Judge Subramanian ruled to exclude evidence obtained during a sweep of Combs’ cell at the Brooklyn Metropolitan Detention Center, which was deemed to have violated attorney-client privilege. The judge also instructed prosecutors to discard 19 pages of notes considered privileged by Combs’ legal team.

If convicted, Combs faces a minimum sentence of 15 years in prison.
