It has been over a year since Daredevil: Born Again dropped its shocking first episode, but for many fans, the death of Foggy Nelson remains a wound that has not fully healed. The moment outside Josie’s Bar, when Bullseye’s bullet struck down Matt Murdock’s best friend, was designed to change everything—and according to star Charlie Cox, it was a decision the creative team agonized over for a long time.

While the series has moved forward, with Season 2 set to premiere on March 24, 2026, on Disney+, the conversation about Foggy’s fate is far from over. In recent interviews and convention appearances, Cox has not only confirmed the finality of the death but also revealed that a very different, happier outcome was seriously considered behind the scenes.

The Scene That Changed Matt Murdock Forever

The premiere episode, “Heaven’s Half Hour,” delivered a gut punch to audiences who had waited years to see the original trio back together. Matt Murdock (Charlie Cox) , Karen Page (Deborah Ann Woll) , and Foggy Nelson (Elden Henson) shared a joyful reunion only to have it shattered when Bullseye (Wilson Bethel) , acting on Vanessa Fisk’s orders, shot Foggy.

For Cox, the weight of that moment was heavy from the very beginning. In interviews following the episode’s release in March 2025, he admitted that wrapping his head around the loss of such a vital character was difficult.

He explained that while he understood the need to shake things up and create a catalyst for Matt’s journey, losing Foggy felt like a “tough pill to swallow.” The death serves as the reason Matt abandons his Daredevil persona for a year and loses contact with Karen, who leaves New York. It set a dark, grounded tone for the rest of the season.

The Scrapped Plan: Foggy in a Cage

As fans watched the season unfold, many held onto a popular theory: that Foggy wasn’t actually dead, but was secretly being held in one of Wilson Fisk’s hidden cages. It seemed possible given Fisk’s anti-vigilante task force and his habit of imprisoning his enemies.

During a recent segment for Entertainment Weekly’s Debunked series, Charlie Cox and Vincent D’Onofrio addressed this theory. While the idea was dismissed by many as wishful thinking, Cox revealed that the theory had a basis in actual development talks.

“So I’ll tell you what’s impressive about that,” Cox said during the interview. “I remember there was a moment where they discussed the possibility of that being the case.”

The alternate plan would have involved a major twist at the end of the first season. Instead of leaving Foggy’s fate ambiguous, the writers considered a reveal that would show Foggy alive, locked in a cage, setting up a rescue mission for the second season.

However, the creative team ultimately decided that this twist did not fit the show’s commitment to realism. “Sadly, that was not the case because we didn’t believe that it was realistic,” Cox explained. “And the thing about our show is we try to keep it as realistic as possible.”

Marvel’s Decision and the Confirmation of Finality

Killing a character as beloved as Foggy Nelson was never a casual decision. Brad Winderbaum, Marvel Studios’ head of streaming, television, and animation, spoke about the intense internal debate surrounding the character’s fate.

“The death of Foggy was something that we really agonized over,” Winderbaum admitted. He compared the loss to that of Gambit in X-Men ’97, emphasizing that characters like Foggy are essential to the story’s core, and losing them creates a permanent impact.

Dario Scardapane, the showrunner who took over during the series’ creative overhaul, also weighed in on how the death was handled. Originally, Foggy’s death was planned to happen off-screen. Scardapane made the decision to bring it to the forefront.

“It was in the material that I inherited, but unfortunately, it was off-screen. And I felt really strongly that if we were to do something that earth-shattering and something that was going to cause such a ripple effect in Matt’s life, we had to see it and we had to feel it,” Scardapane said.

Despite the finality of the scene, some fans remained hopeful, pointing to the fact that Elden Henson is confirmed to return for Season 2. However, Cox has worked hard to temper expectations. At a convention in Monterrey, he was asked directly if Foggy could still be alive.

He acknowledged the “anguish” in fans’ voices when they pitch theories, but he made it clear that the intention was to tell a story about loss and moving forward.

Elden Henson’s Goodbye

For Elden Henson, who played Foggy across the original Netflix series and the revival, saying goodbye was emotional. The actor, who has portrayed Matt’s “avocado at law” since 2015, admitted that the decision to kill the character was not something he pushed for.

During a roundtable discussion with his co-stars, Henson was blunt about his feelings regarding Foggy’s death. “Not my idea,” he said. “Pretty sad. I really liked playing Foggy.”

Despite the tragic end, Henson expressed gratitude for the opportunity to return to the role one last time. He noted that the scene where the trio reunites at the bar before the shooting was a special moment for the cast.

“There was a reunion before we destroyed it,” Henson said, referring to the brief, happy moments shared between Matt, Foggy, and Karen before the tragedy unfolded. Sana Amanat, an executive producer, noted that the loss of Foggy serves as the “emotional heart” of the story moving forward, a permanent scar for Matt Murdock.

How Foggy Will Return in Season 2

With Season 2 arriving on Disney+ on March 24, 2026, the question remains: how will Elden Henson appear if Foggy is truly dead? Marvel has kept the details under wraps, but the answer likely lies in flashbacks.

Given that Matt has been grappling with the trauma of losing his best friend, it makes narrative sense for the series to explore their history through memory sequences. This would allow Henson to return without undoing the emotional stakes established in the first season. While some fans continue to hope for a witness protection twist—a storyline taken directly from the comics—Cox’s recent statements suggest that the character’s death will remain a permanent part of the show’s history.

Meanwhile, the upcoming season promises to expand the world of Hell’s Kitchen. Krysten Ritter returns as Jessica Jones, and the war between Matt Murdock and Mayor Wilson Fisk is set to intensify. But for Matt, the ghost of Foggy Nelson will likely be a shadow that follows him through every fight.

For Vincent D’Onofrio, who plays the Kingpin, there was a sense of relief that his character was not the one directly responsible for Foggy’s demise. During the Debunked interview with Cox, D’Onofrio joked about the weight of that decision.

“I would just like to say, and this is not a lie, that I am happy I wasn’t the one that killed Foggy,” D’Onofrio said.
